Allco Renewable Energy, Ltd. v. Massachusetts Electric Co.

by
In this appeal of a suit brought to enforce section 210 of the Public Utility Regulatory Policies Act (PURPA), 16 U.S.C. 824a-3 the First Circuit affirmed the judgment of the district court dismissing Allco Renewable Energy Limited’s claim against Massachusetts Electric Company d/b/a National Grid and the district court’s denial of Allco’s motion for additional relief against various Massachusetts Department of Public Utilities (MDPU) officials after the district court invalidated certain MDPU regulations as inconsistent with PURPA. The court held (1) the district court was correct in ruling that section 210 of PURPA does not provide a private right of action against utility companies such as National Grid; and (2) the district court did not abuse its discretion in limiting itself to invalidating the MDPU regulations at issue.
